Warranty, Sole Remedies, and Limitation of Damages

(a) Warranty. Essentially Shop LLC does not make any express warranty regarding the product. Your sole remedy, and the sole obligation of Essentially Shop LLC for defective product is for Essentially Shop LLC to replace, free of charge, any product that is defective if, and only if, you give Essentially Shop LLC notice of the defective product within the 14-day period starting on the date of delivery of the product. Essentially Shop LLC does not make any other express warranty regarding the product.

(b) Disclaimer of all Implied Warranties. ESSENTIALLY SHOP LLC SPECIFICALLY DISCLAIMS ALL IMPLIED WARRANTIES FOR THE PRODUCT INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR ANY PARTICULAR PURPOSE.

(c) Sole Remedy for Delivery Breach. Your sole remedy, and the sole obligation of Essentially Shop LLC for a breach of Essentially Shop LLC’s obligation to deliver the product, is for Essentially Shop LLC to deliver to you, free of charge, the quantity of product that Essentially Shop LLC failed to deliver, if, and only if, you give Essentially Shop LLC written notice of the breach within the 30-day period starting on the order date.

(d) Limitation on Damages. In all events, regardless of the legal theory (e.g., breach of contract or warranty, negligence, strict liability, etc.): (1) Essentially Shop LLC IS NOT LIABLE FOR SPECIAL, INDIRECT, INCIDENTAL, EXEMPLARY, CONSEQUENTIAL DAMAGES, OR ECONOMIC LOSS, INCLUDING ANY LOSS OF BUSINESS, PRODUCTION, OR PROFITS; and (2) the total amount of damages that you may recover from Essentially Shop LLC resulting from any occurrence arising in connection with their relationship contemplated by the order is limited to the total value of the product purchased by you that is the subject of the claim.

(e) Statute of Limitations. A Party must commence an action for a breach of contract within one year after the action has accrued.
